Terms of Service

Your use of the Site or Services constitutes your acceptance of these Terms. We may update these Terms from time to time as described in Section 15. Your continued use after any update constitutes acceptance of the revised Terms.

You must be at least 18 years of age to create an account, book consultations, purchase Provisions, or subscribe to Services. Parents or legal guardians with authority to act on behalf of a minor may register that minor for the HEXIS Youth Athletics program and must accept these Terms and the separate liability waiver on the minor's behalf.

You represent and warrant that you have the legal capacity and authority to enter into these Terms and that all information you provide to us is accurate, current, and complete.

Certain features of the Services, including ordering Provisions and managing subscriptions, require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree to use the Site and Services only for lawful purposes and in accordance with these Terms. You will not:

• Use the Services in any manner that violates any applicable law or regulation.
• Provide false, misleading, or incomplete information.
• Interfere with or disrupt the Site, Services, or any related servers or networks.
• Attempt to gain unauthorized access to any portion of the Site, accounts, or systems.
• Use the Services to harass, abuse, threaten, or harm any person.
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our express written permission.

We reserve the right to suspend or terminate your access or account at any time for violation of these Terms or for any other reason in our reasonable discretion.

• Consultations: HEXIS Health offers health and wellness coaching consultations focused on topics such as hormone optimization (including references to HRT and TRT), nutrition, training, and related lifestyle education. These are coaching and educational services only.
• HEXIS Youth Sports: A training program for minors. Participation requires registration by a parent or legal guardian, provision of required participant and emergency information, and acceptance of a separate liability waiver and assumption-of-risk agreement presented during the registration process.
• Provisions: Prepared meals available for purchase on a one-time or recurring monthly subscription basis, with options for pickup or delivery as offered at checkout.

We reserve the right to modify, suspend, or discontinue any Service (or any feature) at any time without prior notice.

All prices, fees, and charges for the Services are as displayed on the Site at the time of purchase and are subject to change. Applicable taxes, delivery fees (if any), and other charges will be calculated and displayed at checkout before you complete your purchase.

All payments are processed securely by Stripe. By submitting your payment information, you authorize Stripe and HEXIS Health to charge the amounts due to your provided payment method. We do not store full credit or debit card numbers on our systems.

You are responsible for providing accurate billing and delivery (or pickup) information. Orders are subject to availability. We reserve the right to refuse or cancel any order for any reason, including pricing or availability errors.

Provisions monthly subscriptions automatically renew on a month-to-month basis at the then-current subscription price until you cancel. The subscription will continue indefinitely on a recurring basis unless and until you cancel it in accordance with this Section.

Cancellation: You may cancel your subscription at any time. Cancellation can be completed by logging into your account and following the cancellation instructions, or by emailing support@hexishealthhq.org with your account and subscription details. Cancellation will be effective at the end of the current billing period. You will not be charged for any subsequent billing periods after cancellation takes effect. No partial refunds are provided for the current period upon cancellation.

Trials and promotions: Any free trial, promotional period, or discounted introductory offer does not automatically convert to a paid subscription. You must take affirmative action to purchase or subscribe to continue receiving the Service after the trial or promotional period ends. If you do not subscribe, access to the Service will end at the conclusion of the trial or promo.

You are responsible for keeping your payment method and billing information current and accurate. If a payment fails, we may attempt to collect the amount due and may suspend subscription benefits until payment is successfully processed. Repeated failed payments may result in cancellation of the subscription.

Except as required by applicable law or as expressly stated in these Terms, all sales of Provisions (including one-time orders and amounts already billed for subscription periods) are non-refundable once the order has been prepared or delivered. You may cancel future subscription renewals as described in Section 6 to stop additional billing.

Consultation fees are generally non-refundable for missed appointments or completed sessions. We may, in our sole discretion, permit rescheduling or issue limited credits or refunds on a case-by-case basis.

Youth athletics program fees are subject to the specific terms and refund policy presented to you at the time of registration. Fees are generally non-refundable after the program begins, except as required by law or at our discretion.

To request a refund, credit, or exception, contact support@hexishealthhq.org. Any approved refunds will be processed to the original payment method within a reasonable time.

Participation in the HEXIS Youth Sports training program involves physical activity, training, and exercise. These activities carry inherent and obvious risks of injury, including but not limited to strains, sprains, fractures, falls, collisions, overexertion, and other accidents. Weather, equipment, facilities, and the actions of other participants may also present risks.

By registering a minor for the program, you (the parent or legal guardian) acknowledge these risks and voluntarily assume them on behalf of the participant. You represent that the minor is physically fit to participate and that you have disclosed all relevant medical conditions, allergies, or limitations in the registration information.

A separate Liability Waiver and Assumption of Risk agreement is presented during the registration process and must be reviewed and accepted by the parent or guardian before participation is confirmed. That waiver is a distinct and binding legal agreement in addition to these Terms. It contains important releases of liability, waivers, and indemnification provisions. Acceptance of the waiver is a condition of the minor's participation.

To the maximum extent permitted by Montana law, HEXIS Health, its owners, staff, contractors, facilities, partners, and agents are not liable for injuries, losses, or damages arising from participation in the youth program to the extent such liability has been released or limited in the waiver or by applicable law. Parents and guardians remain responsible for the minor's safety and conduct and for ensuring the accuracy of all provided information.

The youth athletics program is a training and coaching service. It is not medical care or a substitute for evaluation or treatment by a licensed physician.

All content, materials, text, graphics, images, photographs, videos, logos, designs, software, and other intellectual property appearing on or made available through the Site or in connection with the Services are owned by HEXIS Health or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may access and use the content solely for your personal, non-commercial use in connection with the Services as permitted by these Terms. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content except as expressly permitted by these Terms or with our prior written consent.

We use third-party service providers to deliver portions of the Services:

• Stripe processes all payments. Your payment information is subject to Stripe's terms and privacy policy. We do not store full card details.
• Calendly handles consultation scheduling.
• Resend delivers transactional emails.
• Google Analytics 4 and Google Tag Manager provide usage analytics.

Your use of these integrated services is governed by the third party's own terms of service and privacy policy. We are not responsible for the availability, accuracy, or practices of any third-party service. The Site may also contain links to external websites; we have no control over and are not responsible for the content, privacy practices, or availability of those sites.

The Site and Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

We do not warrant that the Site or Services will be uninterrupted, secure, accurate, error-free, or meet your expectations or requirements. We make no warranty regarding the quality, safety, or results of any consultation, training program, or meal.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on applicable statutory rights. In those jurisdictions, the above exclusions and limitations apply only to the extent permitted by law.

To the maximum extent permitted by applicable law, HEXIS Health and its owners, officers, directors, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, business interruption, or personal injury, arising out of or in any way connected with your use of (or inability to use) the Site or Services, any consultation, the youth athletics program, any Provisions order, or any content, regardless of the form of action or theory of liability (whether in contract, tort, strict liability, or otherwise), even if advised of the possibility of such damages.

Our total liability to you for all claims arising out of or relating to the Site or Services shall not exceed the total amounts you paid to us for the specific service giving rise to the claim during the twelve (12) months immediately preceding the claim (or, if no payments were made, $100).

The foregoing limitations are a fundamental basis of the bargain and a material term of these Terms. They apply even if any remedy fails of its essential purpose.

You agree to indemnify, defend, and hold harmless HEXIS Health and its owners, officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, suits, actions, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• (a) your access to or use of the Site or Services;
• (b) your violation of these Terms or any applicable law;
• (c) your provision of inaccurate, incomplete, or misleading information;
• (d) your registration of, or any conduct related to, a minor in the HEXIS Youth Sports program;
• (e) any content, information, or materials you submit or transmit through the Site or Services; or
• (f) any dispute between you and a third party arising from your use of the Services.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

We may revise these Terms at any time in our discretion. The Effective Date at the top of these Terms indicates the date of the current version. For material changes, we will post the updated Terms on the Site and may provide additional notice (such as by email to registered users). Your continued use of the Site or Services after the Effective Date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must immediately stop using the Site and Services.

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the Services (including the existence, validity, interpretation, performance, breach, or termination of any agreement) shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of laws principles.

Any legal action, suit, or proceeding arising under or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Montana. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to such venue, including on the grounds of forum non conveniens or otherwise. You agree not to commence any action in any other jurisdiction.

These Terms, together with the Privacy Policy and any separate agreements referenced herein (including the youth athletics liability waiver accepted at registration), constitute the entire agreement between you and HEXIS Health with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, representations, and understandings, whether written or oral.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision or of any other right or provision.

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign these Terms and our rights and obligations. These Terms will be binding upon and inure to the benefit of the parties and their permitted successors and assigns.
